Section 01

Acceptance of Terms

By accessing, browsing, or using any website, portal, or digital content service operated by Atlas Dados Portais de Conteúdo na Internet Ltda. — including but not limited to websites published under the domains managed by the company — you acknowledge that you have read, understood, and agree to be bound by these Terms of Use in their entirety, as well as our Privacy Policy and any additional guidelines or policies incorporated herein by reference.

If you do not agree with any part of these Terms, you must immediately cease using our websites and services. Your continued use of any Atlas Dados platform after changes are published constitutes your acceptance of the revised Terms.

These Terms constitute a legally binding agreement between you (whether as an individual or on behalf of a legal entity) and Atlas Dados Portais de Conteúdo na Internet Ltda., a company incorporated under the laws of the Federative Republic of Brazil.

If you are accessing our platforms on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" shall include both yourself and that organization.

Section 02

Use of the Website

Our websites and digital portals are made available for lawful, informational, and editorial purposes only. Access is granted on a temporary basis, and we reserve the right to withdraw or amend any part of our services without prior notice.

You are permitted to access and use our websites for personal, non-commercial purposes, provided you comply with these Terms at all times. Specifically, permitted uses include:

  • Reading and sharing editorial and informational content for personal reference or non-commercial purposes, with appropriate attribution to Atlas Dados.
  • Navigating our platforms to access publicly available articles, data summaries, and market commentary.
  • Using our contact information to send legitimate inquiries to our editorial or commercial teams.

We make reasonable efforts to ensure our websites are accessible at all times, but we do not guarantee uninterrupted availability. Scheduled maintenance, technical failures, or events beyond our control may periodically affect service availability. We accept no liability for any loss or inconvenience arising from such interruptions.

You are responsible for making all necessary arrangements to access our websites, including ensuring your device and browser are compatible with our platforms. You are also responsible for ensuring that all persons who access our websites through your connection are aware of these Terms and comply with them.

Section 03

Intellectual Property

All content published on platforms operated by Atlas Dados Portais de Conteúdo na Internet Ltda. — including but not limited to articles, reports, data analyses, infographics, photographs, videos, illustrations, logos, trade names, layout and design elements, software, source code, databases, and editorial compilations — is the exclusive intellectual property of Atlas Dados or its duly licensed content partners and suppliers, and is protected under Brazilian Federal Law No. 9,610/1998 (Lei de Direitos Autorais), as well as applicable international intellectual property conventions to which Brazil is a signatory.

No portion of our content may be reproduced, republished, distributed, broadcast, transmitted, adapted, modified, publicly performed, or commercially exploited in any form or by any means — whether electronic, mechanical, photographic, or otherwise — without the express prior written authorization of Atlas Dados or the relevant rights holder.

The trademarks, trade names, logos, and service marks displayed on our websites are registered or unregistered marks of Atlas Dados Portais de Conteúdo na Internet Ltda. or its affiliates. Nothing on this website should be construed as granting any license or right to use any such mark without our prior written consent.

Limited use of content for purposes of commentary, criticism, journalistic reporting, or education may be permitted under the fair-use provisions of applicable law, provided that the source is clearly attributed and the use does not damage our commercial interests or misrepresent our editorial positions. When in doubt, please contact us before reproducing any of our materials.

Section 04

User Conduct

When using our websites, you agree to conduct yourself responsibly and lawfully. You must not use our platforms in any way that causes, or is likely to cause, damage to our reputation, disruption to our services, or harm to other users or third parties. The following actions are expressly prohibited:

  • Using our websites to transmit, distribute, or store any material that is unlawful, defamatory, obscene, offensive, or otherwise objectionable under applicable law.
  • Engaging in any conduct that infringes the intellectual property, privacy, or other rights of Atlas Dados or any third party.
  • Attempting to gain unauthorized access to any part of our websites, servers, databases, or associated network infrastructure through hacking, password mining, or any other means.
  • Introducing, uploading, or transmitting viruses, malware, ransomware, spyware, trojan horses, worms, logic bombs, or any other malicious or harmful code or programs.
  • Deploying automated tools — including bots, scrapers, crawlers, spiders, or data-harvesting scripts — to extract, index, or aggregate content from our websites without our express written consent.
  • Using our platforms to send unsolicited commercial communications (spam), conduct phishing attacks, or impersonate Atlas Dados, our employees, or any other person or entity.
  • Circumventing, disabling, or otherwise interfering with security-related features of our websites, including features that prevent or restrict copying of content or enforce usage limits.
  • Engaging in any activity that places a disproportionate or unreasonable burden on our infrastructure, or that interferes with the normal operation of our services for other users.

We reserve the right to report any breach of these conduct requirements to the relevant law enforcement authorities and to cooperate fully with any investigation. We may also take immediate technical measures to block access from any IP address, device, or user account associated with prohibited conduct, without prior notice and without incurring any liability to you.

Section 06

Disclaimer of Warranties

Our websites and all content, data, information, materials, and services accessible through them are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express, implied, or statutory.

To the fullest extent permitted by applicable Brazilian law and any other relevant jurisdiction, Atlas Dados Portais de Conteúdo na Internet Ltda. expressly disclaims all warranties, including but not limited to:

  • Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement of third-party rights.
  • Any warranty that our websites will be available continuously, uninterrupted, error-free, or free from viruses or other harmful components.
  • Any warranty regarding the accuracy, completeness, timeliness, reliability, or suitability of any content or data published on our platforms for any specific purpose.
  • Any warranty that defects in our websites or their content will be corrected within any specific timeframe.

Content published on our platforms is intended for general informational and editorial purposes only. It does not constitute professional advice — including financial, legal, medical, investment, or tax advice — and should not be relied upon as such. You should consult a qualified professional before taking any action based on information obtained from our websites.

Market data, statistics, and analytical content on our platforms may be based on sources we consider reliable, but we make no representation as to their accuracy or completeness and assume no obligation to update such information after publication.

Section 07

Limitation of Liability

To the maximum extent permitted by law, Atlas Dados Portais de Conteúdo na Internet Ltda., its directors, officers, employees, agents, licensors, and service providers shall not be liable to you or any third party for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with:

  • Your access to or use of — or inability to access or use — our websites and platforms.
  • Any reliance placed on the accuracy, completeness, or timeliness of any content, data, or information published on our platforms.
  • Any unauthorized access to or alteration of your data, device, or transmissions related to your use of our services.
  • Statements or conduct of any third party linked to or mentioned on our platforms.
  • Any technical failures, system outages, service interruptions, or errors beyond our reasonable control.
  • Any loss of revenue, profits, business opportunities, anticipated savings, goodwill, or data arising from your use of our platforms, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. Where such restrictions apply, our liability will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms shall limit or exclude our liability for fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Brazilian consumer protection law (Lei No. 8,078/1990 — Código de Defesa do Consumidor) or any other mandatory legal provision.

Section 08

Indemnification

You agree to indemnify, defend, and hold harmless Atlas Dados Portais de Conteúdo na Internet Ltda., its corporate affiliates, subsidiaries, and each of their respective directors, officers, employees, agents, licensors, suppliers, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses — including reasonable attorneys' fees and court costs — arising from or relating to:

  • Your access to or use of our websites or platforms in violation of these Terms.
  • Any content you submit, transmit, share, or make available through our platforms in breach of applicable law or third-party rights.
  • Your violation of any applicable law, regulation, or the rights of any third party, including intellectual property rights, privacy rights, or consumer protection obligations.
  • Any misrepresentation you make regarding your identity, authority, or your right to use our platforms.
  • Any wilful misconduct or gross negligence on your part in connection with the use of our services.

We reserve the right to assume exclusive control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate fully with our defense of such matter. You may not settle any claim subject to indemnification without our prior written consent.

Section 09

Governing Law & Jurisdiction

These Terms of Use, and any dispute, controversy, or claim arising out of or in connection with them — including any question regarding their existence, validity, interpretation, breach, or termination — shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law provisions.

The parties irrevocably agree that the courts of the Comarca de São Paulo, State of São Paulo, Brazil shall have exclusive jurisdiction to settle any dispute or claim arising from or in connection with these Terms or their subject matter or formation, and each party waives any objection to proceedings in such courts on the grounds of inconvenient forum or otherwise.

Specifically, these Terms are subject to, among others:

  • Lei No. 12,965/2014 (Marco Civil da Internet) — Brazil's legal framework governing internet use, rights, and responsibilities.
  • Lei No. 13,709/2018 (Lei Geral de Proteção de Dados — LGPD) — Brazil's General Data Protection Law, as it applies to the processing of personal data.
  • Lei No. 9,610/1998 (Lei de Direitos Autorais) — Brazil's Copyright Law, governing intellectual property protections.
  • Lei No. 8,078/1990 (Código de Defesa do Consumidor) — Brazil's Consumer Protection Code, where applicable to end-user relationships.

If any provision of these Terms is found by a competent court to be unlawful, void, or unenforceable under applicable law, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.
